2:51:16 PM [Jeff Startzman] Not sure what you are asking exactly, I cannot give you legal advice. But if you receive an income withholding it is because the CSEA has classified you as a payor. Income withholdings are sent to payors, not simply employers.
 
Question: I got this administrative lien in the mail. What's this?
Answer:   Whenever a case goes into default, which means it is over 30 days past due, a notice is sent out. If you do not challenge the fact that you are behind, then the case is found to be in default and the CSEA can administratively enforce the court order. One of the most common tools we use is an administrative lien. This lien attaches to all personal and real property that an obligor owns. It never expires, and it is fluid. In other words, the amount of the lien can go up or down depending on the amount of the arrearage. When someone goes to sell a car, a boat, a house, etc., the lien must be paid before the sale can be completed. We have wiped out over $2 million from the liens that we have filed.

Question:
If both the mother and the father are under 18, is there child support ordered if they're not married?
Answer:   There could be. Just because paternity is established, it does not mean that either parent must pursue a support order (if there is no cash public assistance). When support is pursued and the parent is a minor, the income of the the grandparents are used in the child support guidelines to establish an order. So grandparents would pay support until the parents turn 18.


Question:
What if my girlfriend won't agree to visitation or even doing the paternity thing?
Answer:   You can come to our agency and open a case to establish paternity. It is a common misconception that only the mother can come to us and request our services.

Question: If a father pays child support, does that means he gets to see the child?
Answer:   Under Ohio law, if an unmarried woman gives birth she is the custodial parent of the minor child. The father can establish paternity by signing an Acknowledgement at the hospital, but even if he does, that does not change who has custody. Once paternity is established, the parents can either work out a parenting time schedule, or if they can't, either can go to court and ask the court to set up visitation. A father can also seek custody if he believes that would be in the best interest of the child.

I hear everyone in Child Support is moving. What's up with that? Can I still make a payment at 800 Broadway?
Answer:   Pretty much true. With our agency downsizing, we are able to get almost all staff into the A&D Building at 222 E. Central Parkway. All of the staff that were at 237 William Howard Taft will be downtown by the end of October. However, the Cashier's Office at 800 Broadway will continue to take payments.

Question: I am married, but have been separated from my husband. I'm now pregnant with my boyfriend's baby. He is willing to sign the birth certificate, will that be enough to establish paternity?
Answer:   No. He can certainly sign the birth certificate, but because you are married, the law presumes your husband is the legal father. You can have this "undone" through a divorce proceeding or you can contact our office and request that your boyfriend be established as the legal father. This may require him, you, the child and your estranged husband having a genetic test so that we can get a court order of paternity.

Question: I hear there is going to be a new standard applied to people who are behind and have their passports denied?
Answer:   Yes. The state has put forth new rules that are zero tolerance for personal travel. In other words, if somebody is going on vacation and is behind on their child support, they must pay off their entire arrearage in order to get their passport. There are exceptions, but the standard is much tougher than it used to be.

2:11:50 PM [Visitor] That is where a problem comes in... We called a technician & he told us we had to pay $100, request a hearing & then it would be stopped. That if my sons father does not pay, he will have his license suspended. He said a new law was put in place September 1st.

2:10:36 PM [Jeff Startzman] Yes. Please mail or fax the marriage certificate (not the marriage license) to our attention ASAP. You can call your technician and let them know it's coming, too.

Question: How do I go about setting up a child support case?
Answer:   
Someone can contact us at 946-1000 and request to be connected to child support. Our Intake people can send a packet in an application to you. We can then establish paternity, if necessary, or proceed directly to establishing support if paternity has already been determined. If there is an order and it needs enforced, you will speak directly to the technician who has your case and is working on it.
